1 Acceptance of Terms

By accessing or using GoMySpace's website (gomyspace.com), mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"), our Privacy Policy, and any additional guidelines posted on the Platform.

If you do not agree with any part of these Terms, you must not use our Platform. These Terms constitute a legally binding agreement between you and GoMySpace Real Estate Pvt. Ltd.

2 Eligibility

To use our Platform, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into binding contracts under applicable law.
• Not be barred from using our Services under any applicable laws.
• Provide accurate, current, and complete information during registration.

By using GoMySpace, you represent and warrant that you meet all the above eligibility requirements.

3 Account Registration & Security

• You must register using a valid Indian mobile number. OTP verification via WhatsApp is required.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to notify us immediately at support@gomyspace.com of any unauthorised access.
• You may not share your account with others or create multiple accounts for the same person.
• GoMySpace reserves the right to suspend or terminate accounts that violate these Terms.

4 Property Listings & Content

When you post a property listing, you agree that:

• You are the legal owner or authorised agent for the property being listed.
• All information provided is accurate, truthful, and not misleading.
• Photos and media uploaded are your own or you have rights to use them.
• The listing does not violate any applicable laws, third-party rights, or our content guidelines.
• You grant GoMySpace a non-exclusive, royalty-free licence to display, modify, and distribute your listing content on our Platform and partner networks.

GoMySpace acts as a marketplace and does not verify all listing information. We reserve the right to remove any listing that violates these Terms without notice.

5 Prohibited Activities

You agree NOT to:

• Post false, fraudulent, misleading, or duplicate property listings.
• Engage in spam, unsolicited messaging, or harass other users.
• Attempt to scrape, crawl, or harvest data from our Platform using automated tools.
• Reverse engineer, decompile, or attempt to extract our source code.
• Use the Platform to conduct illegal activities or transactions.
• Impersonate any person, entity, or property owner.
• Post listings for properties you do not own or have authorisation to represent.
• Interfere with or disrupt the integrity or performance of our services.
• Attempt to gain unauthorised access to our systems or other users' accounts.

6 Payments & Fees

• Basic property listings on GoMySpace are free of charge.
• Premium features (featured listings, priority placement, etc.) are subject to applicable fees as displayed on the Platform.
• All fees are in Indian Rupees (INR) and inclusive of applicable GST.
• Payments are processed securely via third-party payment gateways.
• Refunds are subject to our Refund Policy. Premium listing fees are generally non-refundable once a listing goes live.
• We reserve the right to change pricing at any time with reasonable notice.

7 Intellectual Property

All content on the GoMySpace Platform, including but not limited to logos, text, graphics, software, and databases, is the exclusive property of GoMySpace Real Estate Pvt. Ltd. and is protected by applicable intellectual property laws.

You may not copy, reproduce, republish, upload, post, transmit, or distribute any part of our Platform content without prior written permission from GoMySpace.

8 Disclaimers & Limitation of Liability

GoMySpace is a technology platform that connects property buyers, sellers, and tenants. We are not a real estate broker, agent, or party to any property transaction.

• We do not guarantee the accuracy, completeness, or legality of any listing.
• We are not liable for any disputes, losses, or damages arising from property transactions conducted through our Platform.
• Our total liability to you for any claim shall not exceed the amount you paid to GoMySpace in the 12 months preceding the claim.
• We exclude all implied warranties to the maximum extent permitted by applicable law.

Users are encouraged to conduct due diligence, verify property documents independently, and consult legal professionals before any property transaction.

9 Indemnification

You agree to indemnify, defend, and hold harmless GoMySpace, its directors, employees, and partners from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Platform in violation of these Terms.
• Content you post or transmit through our Platform.
• Your violation of any applicable laws or third-party rights.

10 Termination

GoMySpace reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may also terminate your account at any time by using the account deletion feature in your profile settings or by submitting a request on our Data Deletion Request page. Upon termination, your right to use the Platform ceases immediately.

11 Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

Prior to initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation for a period of 30 days. Unresolved disputes may then be submitted to arbitration under the Arbitration and Conciliation Act, 1996.

12 Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide reasonable notice via email or a prominent notice on our Platform. Your continued use after the effective date of revised Terms constitutes your acceptance.
